Oversight Shift from EPA to FCC: Historically, the Environmental Protection Agency (EPA) had a role in researching and advising on health effects of non-ionizing radiation (like radiofrequency signals). In the early 1990s, as mobile technology boomed, telecom lobbyists pushed to consolidate RF regulation under the FCC – an agency focused on communications technology, not health​ rfsafe.com. In 1995–1996, Congress cut the EPA’s budget for RF radiation research, effectively defunding the EPA’s Office of Radiation Programs that was poised to set more protective RF exposure limits​. By the mid-1990s, the EPA’s authority in this domain was dismantled, leaving the FCC as the de facto regulator of RF safety despite its lack of medical expertise. The FCC, relying on input from industry and military engineers, adopted exposure guidelines based solely on acute thermal effects (tissue heating) and ignored biological effects that occur at lower exposures​. 2. Legal Frameworks to Address

Enforcing it now would entail directing the appropriate federal agencies (for example, EPA in cooperation with FDA and OSHA) to resume ongoing research on the biological effects of RF and EMF, and to update exposure regulations whenever new evidence shows a need​. It would also mean providing these agencies with the necessary funding and authority to carry out this work, reversing the mid-1990s cuts​. Reactivating Public Law 90-602’s mandate would immediately restore proper health protections by ensuring that safety standards are not allowed to stagnate. For example, when the National Toxicology Program’s recent study found clear evidence of carcinogenicity from cell phone radiation, enforcement of Public Law 90-602 would have required that regulators respond with strengthened exposure limits and further research​. In short, reinstating the continuous research and oversight framework of Public Law 90-602 would correct the current vacuum in RF health regulation, bringing expert health agencies back into the process and restoring a science-based approach to safety. This approach was envisioned in 1968 and is even more urgently needed today in the era of ubiquitous wireless devices.

3. Scientific Documentation of Non-Thermal RF Harm

Extensive scientific research – from military and government studies to independent peer-reviewed papers – has documented harmful biological effects of radiofrequency (RF) exposure at levels far below the thresholds that cause measurable heating. These “non-thermal” effects directly contradict the FCC’s outdated thermal-only safety assumption, and underscore the need for health-focused regulation. Below is a summary of key findings from different sectors, illustrating the broad consensus that RF radiation can affect human biology even without heating tissue:

  • U.S. Military Research (1970s–1980s): Cold War era military studies, including classified Air Force and Navy research, found that prolonged low-level microwave exposure could impair cognitive function, alter the nervous system, and weaken the immune system in animals and personnel – all in the absence of significant heating​. For example, radar technicians exposed to moderate RF levels showed neurological and behavioral changes. These early findings were often ignored or kept quiet in civilian safety standards, but they provided clear evidence decades ago that RF radiation is not “biologically inert” below thermal limits​.

  • Industry’s Own Research (1990s): In the 1990s, the CTIA funded a $25 million research project to investigate cell phone safety. Preliminary results of this industry-commissioned study indicated biological harms – including DNA damage and increased tumor markers in some experiments. Instead of acting on these findings, the CTIA reportedly suppressed the results and publicly denied any risk, terminating the research program before it could fully inform safety guidelines​. Other researchers have found impacts on brain neurons, protein expression, and cell membranes at exposure levels well below FCC limits, reinforcing that biological systems respond to the electromagnetic stimulus of RF fields in multiple ways (e.g. through voltage-gated calcium channels, reactive oxygen species generation, etc.) even without heating​.

  • National Toxicology Program (NTP) Study (2018): The NTP, a program of the U.S. National Institutes of Health, conducted one of the largest and most rigorous animal studies on cell phone radiation. In 2018, after a multi-year experiment exposing rats and mice to GSM and CDMA cellphone signals, the NTP reported “clear evidence” that RF radiation causes cancer – specifically, malignant schwannomas (nerve tumors) in male rats’ hearts, along with DNA damage in brain cells​. Notably, these effects occurred at exposure levels that did not significantly heat tissue, confirming non-thermal mechanisms. Rather than update regulations, the FCC (and FDA) dismissed the NTP results – a move later deemed capricious by a federal court (see Section 5) – and federal funding for follow-up RF health research was halted shortly thereafter​.

  • Ramazzini Institute Study (2018): At the same time as the NTP study, Italy’s Ramazzini Institute conducted a large lifetime study of rats exposed to radiofrequency radiation from a distant source (to simulate exposure from a cell tower antenna). The Ramazzini study found a significant increase in the same rare schwannoma heart tumors in male rats that the NTP found, even though Ramazzini’s exposure levels were orders of magnitude lower (i.e. within legal “safe” limits for the public)​. This independent replication strengthened the evidence that chronic, low-intensity RF exposure can be carcinogenic. Together, the NTP and Ramazzini results directly contradict the FCC’s thermal safety model – showing harm at levels that do not noticeably heat tissue.

  • Epidemiological and Clinical Evidence: Epidemiological studies on humans have raised alarms as well. For instance, long-term cellphone use has been linked in some studies to increased risk of brain tumors (gliomas and acoustic neuromas) on the side of head where the phone is used. Pooled analyses by independent researchers (e.g. Lennart Hardell in Sweden) found that heavy mobile phone users had higher odds of developing certain brain cancers, with risks appearing after 10+ years of exposure – patterns consistent with a carcinogenic effect. Other population studies have associated residence near cell towers with symptoms of electromagnetic hypersensitivity, headaches, and memory problems in some individuals, again at exposure levels far below thermal thresholds. These correlations, while sometimes contested, reinforce biological plausibility that chronic RF exposures can impact human health beyond just heating.

  • BioInitiative and Other Reviews: In 2012, an international team of researchers released the BioInitiative Report, reviewing over 1,800 studies on EMF and RF bioeffects. It concluded that chronic exposure to low-intensity RF fields can lead to oxidative stress, DNA damage, neurological effects, and fertility problems, even though these occur without any noticeable heating​. The BioInitiative authors pointed out that many biological endpoints (gene expression, stress protein induction, sperm motility, etc.) are affected by RF at levels well below current safety limits, and they recommended much stricter exposure guidelines. Similarly, the International Agency for Research on Cancer (IARC) – part of the World Health Organization – reviewed the evidence and in 2011 classified RF electromagnetic fields as “Possibly Carcinogenic to Humans” (Group 2B) based on links to glioma and acoustic neuroma. Since then, experts (including some IARC panelists) have suggested that given newer studies like NTP, RF should be upgraded to Group 2A (“Probably carcinogenic”) or even Group 1 (“Carcinogenic”). In 2021, a large analysis by the National Institutes of Health found that RF radiation can alter neural development and memory in animal models without causing any heating, which is consistent with reports of cognitive impacts in some human studies. Overall, the scientific literature now counts thousands of papers documenting bio-effects of RF at sub-thermal levels, encompassing cellular, animal, and human epidemiological research. This body of evidence – much of it from governmental or independent sources – demonstrates that the FCC’s singular focus on avoiding acute thermal injury is insufficient to protect public health​.

In sum, science has thoroughly debunked the myth that “only heating matters.” RF radiation can trigger a variety of physiological responses – from DNA breaks and oxidative stress in cells to functional changes in brain activity – without raising tissue temperature. This knowledge has been available to regulators for decades. The fact that U.S. guidelines have not been updated accordingly (unlike some countries that have more stringent limits or precautionary policies) is a direct outcome of regulatory capture, not scientific uncertainty. Recognizing these non-thermal effects is essential to crafting protective policy, which is why enforcing research mandates and empowering health agencies (Sections 2 and 5 of this paper) is so urgent. The current FCC RF exposure limits are not only outdated; they are scientifically indefensible in light of the documented non-thermal harms​. Addressing this discrepancy is a public health imperative.

4. Policy Demands

To reverse the effects of telecom regulatory capture and safeguard public health, we propose the following policy actions. These measures directly address the gaps and problems identified above. Each demand is aimed at restoring scientific integrity, local autonomy, and health-based oversight in telecommunications regulation:

  • Repeal Section 704 of the 1996 Telecommunications Act: Congress should remove the provision that prohibits local and state governments from considering health or environmental effects of RF emissions in wireless facility siting. Repealing Section 704 would restore local control over cell tower placement and empower communities to protect themselves​. Local authorities would regain the ability to “regulate cell tower placements based on health concerns,” which is currently outlawed​. This repeal is fundamental to re-balancing power: it would allow cities and states to set their own wireless infrastructure standards (such as safe setbacks from homes or schools, or careful review of new 5G small cell deployments) in line with local needs and current science. In addition, removing Section 704’s preemption would encourage telecom companies to collaborate with communities on safer solutions (since communities could otherwise deny towers) – incentivizing industry to adopt lower-risk designs and technologies. Ultimately, this change respects citizens’ rights and the principle of federalism, while still permitting wireless expansion under locally determined conditions. Restoring local decision-making ensures that environmental health impacts are not dismissed, and it adds a layer of public accountability over telecom projects that has been missing since 1996​.

  • Reinstate and Enforce Public Law 90-602 (1968 Radiation Control Act): The federal government must reactivate the mandate for continual RF safety research and standard-setting. This means providing funding and authority for agencies (such as the FDA’s Center for Devices/Radiological Health, in coordination with EPA and NIEHS) to conduct ongoing research on non-thermal biological effects and to update RF exposure limits in light of new findings. In practice, enforcing Public Law 90-602 today would involve establishing a dedicated RF research program (for example, restarting the halted National Toxicology Program studies on cellphone radiation) and convening regular expert reviews of the science to revise safety regulations. The law’s original intent – continuous vigilance to “minimize…unnecessary radiation” – should be honored by making continuous RF health research a legal requirement, not an afterthought​. Congress should earmark sustained funding for independent research (insulated from industry influence) to investigate long-term, low-level exposure effects on humans and the environment. Importantly, enforcing this law would ensure that our standards are not allowed to stagnate for decades again. Instead, guidelines would be periodically tightened if evidence shows risks (much like how FDA updates drug safety warnings as new data emerge). Reinvigorating Public Law 90-602 would also help drive innovation in safer technologies: when stronger regulations loom, industry has greater incentive to develop and deploy alternatives that emit less radiation. In short, continuous research and adaptive regulation will bring U.S. RF policy up to date and keep it scientifically grounded​.

  • Return RF Regulatory Authority to the EPA (and Health Agencies): Shift the primary responsibility for RF exposure standards and safety compliance away from the FCC and back to agencies with health and environmental expertise. The Environmental Protection Agency – which once had an active radiation protection program – should be re-empowered (or a new independent expert body created) to develop biologically based RF exposure guidelines and oversee environmental RF emissions impacts​. The FCC’s role should be limited to engineering and enforcement aspects (ensuring telecom operators adhere to the standards set by health authorities), rather than setting the health standards itself. By reinstating the EPA’s authority (with support from agencies like the National Institute for Occupational Safety and Health (NIOSH) for workplace exposures and the FDA for consumer devices), the U.S. would gain regulators who can interpret biomedical research and integrate it into safety limits​. The EPA could, for example, set exposure limits that account for cumulative and chronic exposures, vulnerable populations (such as children or pregnant women), and non-thermal effects like oxidative stress – none of which are accounted for in the current FCC rules. An active EPA oversight would also include monitoring RF pollution in the environment (impact on wildlife, bees, trees, etc., which currently gets almost no official scrutiny)​. To implement this, Congress should formally assign RF protection duties to the EPA, funding its research on environmental RF effects and tasking it with issuing updated safety recommendations. The FCC’s 1996 guidelines could then be replaced or supplemented by EPA’s science-based guidelines (similar to how EPA sets air quality or chemical exposure limits that other agencies enforce). Removing the FCC from health-based RF regulation is critical to eliminate conflicts of interest – the FCC has proven too intertwined with industry to objectively evaluate health hazards​. By contrast, the EPA’s mission is environmental health, making it better suited to prioritize public welfare over industry profit. This realignment would ensure that communications policy and public health policy are both given due weight, rather than telecom economics alone driving decisions. It’s a structural fix to regulatory capture that creates a system of checks and balances: the FCC can still enable spectrum innovation, but the EPA (with input from public health experts) will set the guardrails on radiation emissions that industry must adhere to​.

  • Mandate Li-Fi as a Safer Alternative for Indoor Wireless: Government and industry should promote and require the adoption of Li-Fi (Light Fidelity) – which uses light (e.g. infrared or LED light pulses) to transmit data – as a replacement for traditional radio-frequency wireless in indoor environments. Li-Fi provides high-speed, broadband wireless communication with zero RF emissions, thereby eliminating the health risks associated with Wi-Fi routers, cell signals, and other microwave transmitters in homes, schools, and offices​. We urge policies that make Li-Fi standard in schools and public buildings: for instance, schools could be required to use wired ethernet and Li-Fi systems for internet connectivity, instead of blanket Wi-Fi, to create RF-free learning spaces​. Likewise, workplace safety regulations could encourage Li-Fi in offices where possible. All new wireless consumer devices (laptops, tablets, smartphones, smart appliances) should include Li-Fi capability as a condition for market entry​. This would allow users to connect via light-based networks when indoors, massively reducing overall RF radiation exposure. Li-Fi technology has matured rapidly, achieving gigabit speeds using LED lighting systems. Unlike Wi-Fi, Li-Fi signals do not penetrate walls, which enhances security and allows fine-grained containment of emissions. While Li-Fi isn’t a solution for outdoor wide-area coverage (where wired fiber or 5G would still be used with proper safeguards), it is an ideal solution for indoor and urban hotspot connectivity without adding RF pollution. By mandating Li-Fi in indoor settings (through building codes, school standards, or federal IT requirements), governments can drive economies of scale that make Li-Fi more affordable and widespread. This not only protects public health by “eliminating chronic microwave exposure” in daily life​, but also spurs tech innovation (industry will compete to provide better Li-Fi products). Several forward-looking jurisdictions and companies have already begun piloting Li-Fi for safer wireless communication; it’s time to scale it up. In summary, Li-Fi should be a central pillar of a health-conscious connectivity strategy – allowing us to enjoy wireless convenience in ways that “do no harm” to ourselves or our children.

5. Legislative, Regulatory & Legal Strategies

Achieving the above reforms will require a coordinated strategy spanning legislation, regulatory action, and litigation, supported by public advocacy. This section outlines concrete steps and avenues for lawmakers, regulators, legal experts, and activists to reverse telecom regulatory capture and implement health-protective policies:

a. Enact Federal Legislation to Reform Wireless Safety Oversight: Congress should draft and pass comprehensive legislation that overhauls the current RF regulatory framework. Key elements of this model legislation would include: (1) Repealing Section 704 of the Telecom Act to remove the federal preemption on health-based siting rules (thus restoring local and state authority over wireless infrastructure)​; (2) Assigning RF environmental health regulation to the EPA (and/or an independent commission of EMF scientific experts), with a clear mandate to establish exposure guidelines based on the latest science; and (3) Enforcing Public Law 90-602’s requirements by directing ongoing funding for RF research and requiring periodic review/updating of RF exposure limits by health agencies​. This new “Electromagnetic Safety Act” could amend the Communications Act and the 1968 Radiation Control Act to clarify roles and ensure that public health takes priority in wireless deployments. It should also contain provisions to protect the research process from industry interference – for example, insulating research funding via HHS or NIH, and creating transparency requirements for any advisory committees. Such legislation might set an immediate interim RF exposure limit (to replace the old FCC limit) based on existing biomedical knowledge (for instance, using international best practices or recommendations from bodies like the BioInitiative Report), to be updated after a full scientific review. Drafting assistance can be sought from experts in environmental law and public health; indeed, some lawmakers at state and federal levels have already shown interest in EMF issues (e.g. bills proposed in Massachusetts and New Hampshire). Building bipartisan support is feasible, as the issue touches concerns about local rights, health, and even national security (resilience of communications). Lawmakers should frame it as a common-sense update to outdated law – much like how regulations for chemicals or drugs are modernized as science advances. In parallel, Congress should hold oversight hearings to investigate FCC’s handling of RF safety and to air the scientific evidence (this can build the record and momentum for the bill). By changing the law, we can definitively break the hold of industry capture – re-establishing an accountable system where public health agencies set the standards and telecom agencies follow them.

b. Strengthen Regulatory Standards and Accountability: While legislation is in progress, executive agencies and regulatory bodies should use their existing powers to start addressing RF safety. For example, the FCC could be petitioned or instructed by the Administration to open a new proceeding to update RF exposure guidelines in collaboration with FDA/EPA input (notwithstanding the FCC’s historical reluctance, a formal record would compel them to confront the evidence). The FDA – which under the 1968 Act does have authority over radiation-emitting electronic products (including wireless devices) – should be urged to exercise that authority by reviewing cell phone and Wi-Fi router safety under the Food, Drug, and Cosmetic Act’s electronic product radiation provisions.
