Judge Patricia Ann Millett, questioning the FCC, highlighted just how out of touch the agency’s reliance on outdated FDA research is: “The FDA coming back and talking about cellphones that are in a holster—where nobody keeps them anymore” underscores the inadequacy of guidelines from a different technological era.
